CBD FAQ – The most common questions about effects, legality & application clearly explained

Is CBD legal in the EU, Germany, and Austria? What does EU law say about legality?

The European Court of Justice ruled in November 2020 that cannabidiol is not a narcotic and may be traded legally, provided it comes from approved EU industrial hemp. This ruling strengthens the legal basis for the free sale and possession of CBD products within the EU.

Is CBD allowed in Germany and Austria?

In Germany and Austria, cannabidiol is legal if it meets certain requirements: The THC content must be below 0.3%. Products like CBD oils made from certified industrial hemp may be sold and possessed freely.

Is CBD classified as a narcotic or addictive substance?

The World Health Organization (WHO) confirms that the hemp compound cannabidiol is not addictive and has a good safety profile. On the contrary, it highlights the therapeutic benefits of the compound in its official report.

Legal classification in the EU

CBD does not fall under the narcotics law as long as it is derived from industrial hemp and the THC limit is adhered to. This was confirmed by the ECJ in 2020, marking an important turning point for the hemp industry.

Can I buy and possess CBD products?

The purchase of CBD products is allowed in the EU and Switzerland as long as the legal THC limits are observed. At HANAFSAN, cannabidiol products are available from the age of 18.

What effects does CBD have, and does it make you high?

No, CBD is not psychoactive and does not cause a "high". The intoxicating feeling is triggered by THC – a cannabinoid that is only present in minimal traces in hemp products from EU industrial hemp.

How is CBD legally regulated? Dietary supplements, cosmetics, or medicine?

In Austria and Germany, CBD oils are not classified as dietary supplements and cannot be marketed as such. Different rules apply to cosmetics – their use is permitted under certain conditions. So far, there are only a few officially approved cannabis medicines in Europe.

What happens during a police check with CBD products?

HANAFSAN guarantees THC-free hemp products (except for technically unavoidable traces). The police are generally well-informed and recognize legal hemp products. Certificates can be presented if there is any doubt.

What is the difference between CBD hemp flowers and marijuana?

CBD flowers come from EU-certified industrial hemp with a THC content of less than 0.3%. "Marijuana," on the other hand, often contains over 20% THC and is therefore psychoactive. This is the crucial difference.

How do I find the right CBD product for me? What should I pay attention to when buying?

A look at the imprint of a website shows whether a reputable manufacturer or just a trading company is behind it. In-house production, certified ingredients, and transparent origin are crucial. HANAFSAN produces in-house and meets the highest standards.

What requirements must a manufacturer meet? Legal requirements and quality standards

Manufacturers must have the appropriate business license, approved production facilities, and meet different regulations depending on the product group (food law, cosmetics law, GMP, etc.). Quality certificates such as BIO or HACCP are a good sign of seriousness and safety.

What is the difference between 5% and 10% CBD oil? Concentration vs. dosage

A 5% CBD oil contains 500 mg of cannabidiol in 10 mL, while a 10% oil contains double the amount, i.e., 1000 mg of cannabidiol in 10 mL. It is important not only to consider the percentage but also the individually suitable dosage – that is, how many drops and how often they are applied.

What are terpenes? Natural aromatic substances with effects

Terpenes are plant compounds that influence the aroma, taste, and possibly the effects of CBD products. They naturally occur in hemp and are an important quality feature in full-spectrum products.

Can I also cook and bake with hemp?

Hemp products are ideal for cooking and baking – especially for vegans, athletes, and health-conscious individuals. On the HANAFSAN blog, you will find delicious and easy-to-implement recipes with high-quality hemp ingredients.
